These Tonal Text Messaging Program Terms (“Messaging Terms”) apply to your participation in the Tonal Systems, Inc. (“Tonal,” “we” or “us”) text messaging service program (“Messaging Program”). Please read these Messaging Terms carefully.

These Messaging Terms supplement and incorporate by reference the Tonal Terms of Service (“Terms of Service”). Capitalized terms used but not defined in these Messaging Terms have the definition given to them in the Terms of Service. Any disputes arising from these Messaging Terms or the Messaging Program, will be subject to the Terms of Service, including the limitations of liability, governing law and dispute resolution procedures specified in the Terms of Service (including the class action waiver and mandatory arbitration terms).

You can choose to participate in the following SMS program:

“SMS Marketing – stay in the know about news, updates and offers from Tonal.”

By participating in the Messaging Program, you agree to receive recurring autodialed text (e.g., SMS and MMS) messages from Tonal to the mobile telephone number you provided when you signed up for the Messaging Program or the mobile telephone number you otherwise designated in connection with the Messaging Program. Consent to receive automated marketing text messages is not a condition of any purchase. Message and data rates may apply.

Message frequency will vary. Tonal reserves the right to alter the frequency of messages sent at any time. Tonal also reserves the right to change the short code or phone number from which messages are sent.
The Messaging Program may not support all mobile devices or handsets, and our messages may not be deliverable in all areas. Tonal, its service providers and the mobile carriers supported by the Messaging Program are not liable for delayed or undelivered messages.

To cancel, reply to a message from us, or text our short code, with the keyword STOP. After texting STOP to our short code you will receive one additional message confirming that your request has been processed. If you unsubscribe from one of our text message programs, you may continue to receive text messages from Tonal through any other programs you have joined until you separately unsubscribe from those programs.
